Terms of Service

By accessing or using SonicStacker (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.

SonicStacker uses artificial intelligence to generate music, lyrics, and audio (“Generated Content”). You acknowledge that:

• Generated Content is created algorithmically and is not the work of human artists, composers, or songwriters.
• The AI model is trained on general musical patterns and knowledge. It does not intentionally replicate, sample, or copy specific copyrighted works.
• Despite our best efforts, AI-generated outputs may coincidentally resemble existing compositions, melodies, or lyrics. Such resemblance is unintentional.
• We do not guarantee that Generated Content is free from resemblance to any existing work, nor that it is original or unique within the meaning of copyright law.
• You assume full responsibility for evaluating Generated Content before commercial use, public release, or distribution. We strongly recommend consulting a qualified attorney if you intend to register copyright or use Generated Content commercially.

Our platform: SonicStacker and its underlying technology, branding, and software are owned by us and protected by applicable intellectual property laws. You may not copy, modify, reverse-engineer, or resell any part of the platform.

Generated Content: Subject to your compliance with these Terms and applicable law, you are granted a non-exclusive license to use the Generated Content you produce. We make no warranty that such content is copyrightable under applicable law, as AI-generated works may not qualify for copyright protection in certain jurisdictions.

Third-party rights: We do not replicate, sample, or knowingly incorporate copyrighted recordings, compositions, or lyrics into our AI outputs. However, because AI generation is probabilistic, outputs are not guaranteed to avoid all resemblance to existing works. You agree not to hold us liable for coincidental similarities.

If you provide prompts, lyrics, descriptions, or other input (“User Input”) to the Service, you:

• Retain all rights you hold in your User Input.
• Grant SonicStacker a worldwide, non-exclusive, royalty-free license to process, store, and use your User Input solely to operate and improve the Service.
• Represent that you have all necessary rights to provide the User Input and that it does not infringe any third-party rights.

You also grant SonicStacker a non-exclusive license to host, serve, and deliver the Generated Content associated with your account for the purposes of operating the Service.

You agree not to use the Service to:

• Upload, submit, or incorporate copyrighted material (including song lyrics, recordings, or compositions) that you do not own or have explicit rights to use.
• Generate content that is hateful, discriminatory, harassing, threatening, defamatory, or that targets individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Generate content that sexualizes minors or depicts non-consensual acts.
• Attempt to reproduce, clone, or reverse-engineer the SonicStacker AI model or infrastructure.
• Misuse the Service in ways that violate applicable laws, including copyright law, privacy law, or consumer protection regulations.
• Use automated means, bots, or scrapers to access the Service at scale without our written consent.

We make best efforts to avoid generating outputs that infringe existing copyrighted works. However, we do not and cannot guarantee that any Generated Content is:

• Unique or original in a legal sense
• Free from similarities to existing commercially released music
• Suitable for copyright registration
• Cleared for all commercial uses without additional clearance

Use of Generated Content for commercial purposes is at your own risk and discretion. We recommend independent legal review before exploiting Generated Content commercially.

AI-generated content labeling: You are responsible for clearly disclosing that content created with SonicStacker is AI-generated when sharing, publishing, or distributing it, particularly in contexts where the distinction between human-created and AI-generated content may be material or where applicable laws or platform policies require such disclosure.

To the fullest extent permitted by applicable law, SonicStacker and its officers, directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Any third-party claims arising from Generated Content, including copyright infringement claims.
• Loss of data, revenue, profits, or business opportunities.
• Service interruptions, errors, or failures.

Our total liability for any claim arising from the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $50 USD.

We respect intellectual property rights. If you believe that content available through our Service infringes your copyright, please send a written notice to support@softstackers.com with the subject line “DMCA Notice,” including:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the infringing content and its location on our Service.
• Your contact information (name, address, telephone, email).
• A statement that you have a good faith belief that the use is not authorized.
• A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We reserve the right to suspend or terminate your account, without notice or liability, if we determine in our sole discretion that you have:

• Violated these Terms
• Engaged in fraudulent or abusive behavior
• Used the Service in a way that harms other users or third parties
• Failed to pay any amounts due

You may cancel your account at any time by contacting us at support@softstackers.com.

SonicStacker offers both free and paid tiers. Paid credits are sold as one-time purchases. You will be charged once at the time of purchase with no recurring billing.

All sales are final. We do not offer refunds except where required by applicable law. If you believe a charge was made in error, contact us within 14 days at support@softstackers.com and we will review your request.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not warrant that Generated Content meets any specific quality, originality, or legal standard.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction located in Texas.

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after any change constitutes acceptance of the new Terms.

By creating an account, you consent to receive transactional emails (confirmations, receipts, security alerts). You may also opt in to marketing communications (feature updates, free credit notifications, tips). You can unsubscribe from marketing emails at any time via the unsubscribe link in each email or by contacting us at support@softstackers.com.
